End User Licence Agreement

1. Licence grant

Subject to your acceptance of these terms, Yacht Genius AI grants you a personal, non-transferable, non-exclusive, revocable licence to access and use the website (yachtgenius.ai) and the Gizmo AI concierge for the purpose of researching, planning and booking a crewed yacht charter for your own account or that of guests you are personally hosting.

Gizmo's responses are generated by a large language model grounded in our verified fleet data. We design Gizmo to refuse to invent yacht details, prices or itineraries; however, no AI output is contractually binding. You acknowledge that:

If you create or use an account on the site, you are responsible for the security of your credentials and for any activity conducted through the account. Notify us immediately of any unauthorised access at info@yachtgenius.ai.

5. Termination

This licence terminates automatically if you breach any of these terms. We may also terminate access at our discretion, with or without notice, for misuse, fraud, or activity that endangers other users, our broker network relationships, or our ability to operate.

On termination you must cease all use of the site and the Gizmo concierge. Sections 2 (Restrictions), 6 (Disclaimer), 7 (Liability) and 8 (Governing law) survive termination.

6. Disclaimer

The site and the Gizmo concierge are provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the site will be uninterrupted, error-free, or that any defects will be corrected.

7. Limitation of liability

To the fullest extent permitted by law, our aggregate liability under this EULA is limited to the brokerage commission earned on a relevant booked charter, or USD $500 where no charter has been booked. We are not liable for indirect, consequential, special, or punitive damages.

8. Governing law

This EULA is governed by the laws of the State of Florida, USA. Disputes are subject to the exclusive jurisdiction of the courts of Broward County, Florida.
