1. Brokerage role
Yacht Genius AI ("we", "us") is a charter brokerage. We do not own, operate, insure, or crew the yachts in our database. Charter agreements are executed between the guest ("you") and the yacht owner or its appointed management company on a standard MYBA-form contract.
Our role is to source matched yachts, present verified specifications, facilitate the inquiry, and support the booking process up to and including the post-charter debrief.
2. Information accuracy
Yacht specifications, photos and rates are sourced from the Central Yacht Agent (CYA) feed and refreshed daily. While we work to maintain accuracy, we cannot guarantee real-time correctness at the moment of viewing. Crew rotations, refits, and seasonal repositioning happen frequently in this market.
Final, contractually-binding details — base rate, APA, taxes, embarkation port, crew composition, water toys aboard — are confirmed in your charter agreement, not in any listing or AI response.
3. Use of Gizmo (AI concierge)
Gizmo is an information assistant. Its responses are grounded in our verified database and are designed not to invent yacht details, prices or itineraries. However, no AI output should be treated as binding. Bookings, prices and availability are confirmed by a human consultant before any contract is executed.
You agree not to attempt to extract proprietary fleet data from Gizmo at scale, automate scraping, or use its output for any commercial purpose other than planning your own charter.
4. Inquiry process
Submitting an inquiry is not a booking commitment. A consultant will reply within one business day with a shortlist and live availability. You may decline any quote without penalty. Booking is initiated only when you sign the charter agreement and pay the agreed deposit.
5. Payments
Payment terms are set by the yacht's management company in the charter agreement. Typical terms: 50% on signing to confirm, 50% before embarkation, plus an Advance Provisioning Allowance (APA, typically 30%) for fuel, food, beverages, harbour fees and shore-side excursions. Unused APA is refunded at the end of the charter.
Yacht Genius AI does not hold guest funds. Payments flow directly to the management company's escrow account per the charter agreement.
6. Cancellation and changes
Cancellation terms are set by the charter agreement and depend on time-to-embarkation. We strongly recommend Charter Insurance covering cancellation (CFAR), damage, and travel medical. Your consultant can introduce a broker.
7. Intellectual property
Site content (copy, design, code, the Gizmo system prompt and grounding architecture) is the property of Yacht Genius AI. The Yacht Genius AI name, logo, and "Gizmo" are trademarks. Yacht photography and specifications are licensed from the respective management companies for use within the brokerage relationship.
8. Limitation of liability
To the fullest extent permitted by law, Yacht Genius AI is not liable for incidents, injuries, delays, weather disruptions, or losses occurring during a chartered voyage. These fall under the charter agreement and the yacht's insurance.
Our aggregate liability for any claim arising from your use of this site or our services is limited to the brokerage commission earned on the relevant charter, or USD $500 if no charter was booked.
9. Acceptable use
You agree not to: scrape the fleet database; redistribute Gizmo responses commercially; reverse-engineer the system; harvest contact details of yacht owners or crew; submit false inquiries to test pricing.
10. Governing law
These terms are governed by the laws of the State of Florida, USA. Any dispute arising from these terms or your use of the site is subject to the exclusive jurisdiction of the state and federal courts of Broward County, Florida. The parties waive any right to a jury trial in such proceedings.
11. Changes
We may update these terms from time to time. Material changes will be flagged on the homepage for 14 days. Continued use of the site after a change constitutes acceptance.
